The present policy describes the methods of management of the site with reference to the processing of personal data of users who consult it, as well as the processing practices of data transmitted by the data subject to the Controller through this site.
In compliance with Articles 13 (for data collected from the data subject) and 14 (for data not collected from the data subject) of Regulation (EU) 2016/679 (GDPR) the following information is provided to the Users of this Website, which refer exclusively to the processing carried out through this Website and not through other websites that may be visited through links from this Website, for which it is suggested to read the relevant information provided by the respective Controllers.
The Website and any services offered through the Website are reserved for persons of age or older. The Controller therefore does not collect personal data relating to persons under the age of 18. At the request of such Users, the Controller will promptly delete all personal data inadvertently collected.

MARESCA S.r.l. whose registered office is in Via Mentana n. 30-32-34 Viadana (MN), tax payer’s and VAT code 00140690207, email info@maresca.it  Tel. 0375 87091 (hereinafter also company name or “Controller"), as the controller of the processing of personal data of users of the site name site (hereinafter, "Users") hereinafter provides the privacy policy pursuant to art. 13 of EU Regulation 2016/679 dating back to April 27, 2016 (hereinafter "Regulation").
The Data Controller reserves the right to appoint a web agency or a consultant, whose references may be communicated upon request to the addresses indicated above, as Data Processor of the personal data managed for the purposes of technical assistance, maintenance, technical management and the like of this Site. The Data Controller and the Data Processor process the Users' data also thanks to their own internal Data Processors, specifically appointed and provided with instructions for the correct processing of personal data, also orally.

2.    Processing scope
The personal data of the Users of the Website, as described above, will be processed in the ways and forms prescribed by GDPR, in order to carry out the functions of the Website, with particular, but not exclusive, reference to the procedures described therein for data collection, contact form, any registration process / reserved area access, subscription to the newsletter and the like.
More precisely, the personal data provided to the Controller will be processed for the following purposes:
To comply with specific requests made to the Controller by the User through the Website and its communication tools (contact form, information request forms and the like);
To eventually subscribe to the newsletter and the consequent sending of commercial communications and various information regarding the sector in which the Controller operates, with the appropriate consent given by the user
To forward communications relating to the services of the Controller himself, following the request for information by e-mail or by filling in the contact form and other communication tools;
For other purposes ancillary or related to those indicated above and in any case falling within the scope of the Website's activities;
To process the e-mail address, provided by the interested party in the context of the sale of a product or service, also aimed at sending, without further consent, communications for the subsequent direct sale of products or services similar to those being sold; the interested party may in any case express his or her refusal and object to such processing, both initially and subsequently, easily and free of charge, by following the instructions in any subsequent communication.
The processing of the data provided generically will be carried out, also following automatic collection during navigation, for the sole purpose of ascertaining and controlling access to the Website. This also applies to technical cookies, to be understood as session, functionality or analytics cookies that meet the requirements specified by the Data processing authority. In particular, with regard to the latter, it is clarified that they can be assimilated to technical cookies where these are created and used directly by the Website. In any case, for said cookie analytics, the Website, also in accordance with the clarifications of the Data processing authority, provided for the anonymization of IP addresses and the amendment of data processing; the collection and use of said navigation data (without prejudice to the anonymization of IP addresses) allow the monitoring of the Website's performance and allow the improvement of the service offered, offering the User a better navigation experience. Data collected through the Email platform
For more information, it is hereby specified that when forwarding any notice, MARESCA S.r.l. profits from a platform, which through statistical tracing, allows to detect when the message is opened, any click on the hypertext links in the e- Email mail, from which IP address and which browser is used to open the e-mail and similar information. The data collection is functional to the platform use and is integral to the message forwarding system functions.
The User may also easily object to further newsletter submissions by clicking on the link for the revocation of consent, which is present in each email containing the newsletter. Once consent revoked, the Controller will send the User a message to confirm the revocation of consent.

3.    Processing juridical foundation
The processing of personal data is based on the right to information, the fulfilment of contractual or social contact obligations, or where necessary on consent by freely and knowingly filling in the appropriate information fields in the dedicated form.

4.    Legitimate interest of the Controller
The processing of personal data is also based on the legitimate interest of the Controller, exercising its rights in the context of the information society, the performance of the contractual service and the implementation of direct marketing operations.

5.    Obligation to transfer
The provision of data relating to navigation by Users, for the above purposes, depends on the degree of privacy that the User enabled or disabled through their browser. In some cases, disabling it may affect browsing on this Website. For certain modules of the present Website, the provision of navigation data and/or the use of technical cookies is mandatory for the correct functioning of the Website itself.
The provision of certain data is in any case necessary for the structure of the Website and its procedures.  Any request for other optional data will be preceded by a tick of approval. The provision of all other data is optional, in accordance with the type of information that the User wishes to provide to the Website.

6.    Recipients of personal data
The data may be communicated to companies connected, associated or controlled by the Controller, as well as to consultants, or even to third parties who operate, also in the name and account of the Controller, for the provision of services related to the purposes indicated in this information notice, both intra-EU and extra-EU (in the latter case, it will be exclusively of subjects adhering to the Privacy Shield protocol).
Navigation and similar data (for which reference should be made to the above), as well as profiling cookies also from third parties (for which reference should be made to the Cookie Policy of this Website), which will be communicated to the respective third parties concerned, if they do not manage them directly as Data Controllers.

7.    Conservation period
The data provided by the interested party will be stored until revoked by the interested party, including through action on his browser, cookie cleaning, express request or in any other way manifested.
The navigation data will be stored for the technical time necessary to perform the functions for which they were collected.

8.    User rights
Each Interested Party has the right of access, rectification, cancellation (oblivion), limitation, receipt of notification in the event of rectification, cancellation or limitation, portability, opposition and not to be the subject of an automated individual decision, including profiling, in accordance with Articles 15 to 22 of the GDPR.
These rights may be exercised in the forms and within the terms set forth in art. 12 GDPR, by means of written communication sent to the Controller by email to the reference email address
The Controller will provide an adequate response as soon as possible and in any case within 1 month of receipt of the request. Pursuant to Articles 15 et seq. of the Regulations, the user has the right to request access at any time.

9.    Right to revoke consent
It is possible to revoke this consent at any time through:
  • Sending an e-mail to the Controller's address: info@maresca.it;
  • Expressing communication at the registered office of the Controller.

10.    Complaints
Each User has the right to lodge a complaint under Articles 77 et following of the GDPR to a supervisory authority, which for the Italian State is identified in the Data processing authority for the protection of personal data.
The forms, methods and deadlines for lodging complaints are provided for and governed by the national legislation in force. The complaint is without prejudice to administrative and jurisdictional actions, which for the Italian State can be proposed alternatively to the same Guarantor or to the competent Court.

11.    Profiling
The personal data provided with the form may be subject to profiling.
Profiling allows the Controller to evaluate certain personal aspects of the Interested Party relating in particular to his/her preferences, interests, tastes with reference to the products sold and the activities carried out by the Controller, in order to allow the Controller to offer the Interested Party a more specific and targeted sales service.
